Utopia - a decentralized exchange (DEX) built on the Solana blockchain, is committed to protecting your privacy. This Privacy Policy explains how Utopia collects, uses, shares, and protects your information when you access or use our platform, services, or website (collectively, the “Platform”). By using Utopia, you agree to the practices described in this Privacy Policy.

Scope

This Privacy Policy applies to all users interacting with Utopia’s non-custodial DEX, including token swaps, liquidity provision, and other DeFi services on the Solana blockchain. As a noncustodial platform, Utopia does not control or store your private keys or funds, which remain under your control via your Solana wallet.

Information We Collect

Utopia collects limited information to facilitate your use of the Platform. We may collect:

  • Blockchain-Related Data: Public Solana blockchain data, such as wallet addresses, transaction details (e.g., token swaps, amounts, and timestamps), and smart contract interactions, which are inherently public and immutable.
  • Usage Data: Information about how you interact with the Platform, including IP addresses, browser types, device information, and session data (e.g., pages visited, features used).
  • Communication Data: Information you provide when contacting us via email, Discord, or other support channels like utopiaproject1@proton.me
  • Cookies and Tracking Technologies: We may use cookies or similar technologies to enhance user experience, analyze Platform performance, and track usage patterns. You can manage cookie preferences through your browser settings.

Utopia does not collect personally identifiable information (e.g., names, email addresses, or government IDs) unless voluntarily provided through support channels or optional account features.

  • Facilitate transactions and services on the Solana blockchain, such as token swaps and liquidity provision.
  • Improve and optimize the Platform’s functionality, performance, and user experience.

  • Comply with applicable legal or regulatory requirements, such as responding to lawful requests from authorities.

How We Share

Your Information as a non-custodial DEX, Utopia primarily relies on public blockchain data, which is inherently transparent. We may share information as follows:

  • Public Blockchain Data: Transaction details (e.g., wallet addresses, swap amounts) are recorded on the Solana blockchain and are publicly accessible to anyone.
  • Third-Party Service Providers: We may share usage or communication data with trusted third parties (e.g., analytics providers, hosting services) to support Platform operations, subject to strict confidentiality agreements.
  • Legal Compliance: We may disclose information to comply with legal obligations, such as responding to subpoenas, court orders, or regulatory investigations.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred, with notice provided to affected users.

Utopia does not sell your personal information to third parties.

Data Retention

  • Blockchain data (e.g., transaction records) is permanently stored on the Solana blockchain and cannot be deleted due to its immutable nature.
  • Usage and communication data are retained only as long as necessary to fulfill the purposes outlined in this Privacy Policy or to comply with legal requirements. Typically, non-blockchain data is retained for up to 180 days, unless longer retention is required for security, fraud prevention, or legal compliance (e.g., tax or accounting purposes, which may require retention for up to 5 years).
  • After the retention period, we securely delete or anonymize non-blockchain data, though copies may remain in encrypted backups for a limited period before being overwritten.

Your Rights and Choices

You have the following rights regarding your information:

  • Access and Correction: You may request access to or correction of any personal information we hold (e.g., communication data) by contacting us at utopiaproject1@proton.me. Note that blockchain data cannot be modified due to its immutability.
  • Opt-Out: You can opt out of cookies or tracking technologies via your browser settings. You may also opt out of marketing communications by following unsubscribe instructions in emails.
  • Data Deletion: You may request deletion of non-blockchain personal data we hold, subject to legal or regulatory requirements. Contact us to submit a request.
  • Complaints: You may lodge a complaint with a relevant data protection authority if you believe we have not handled your data appropriately.

Security

We implement reasonable measures to protect non-blockchain data, including encryption and access controls. However, no system is completely secure, and you are responsible for securing your Solana wallet, private keys, and seed phrases. Utopia is not liable for unauthorized access to your wallet or losses due to user error.

Third-Party Integrations

Utopia integrates with third-party services (e.g., Solana wallets like Phantom or Solflare, other DEXs like Jupiter or Stabble). These services have their own privacy policies, and Utopia is not responsible for their practices. We encourage you to review their policies before using them.

International Data Transfers

Utopia operates globally, and non-blockchain data may be processed in jurisdictions outside your country of residence. We comply with applicable data protection laws, such as the EU’s General Data Protection Regulation (GDPR) or the California Consumer Privacy Act (CCPA), where relevant. For example, data transfers outside the European Economic Area, UK, or Switzerland adhere to legal frameworks ensuring adequate protection.

Children’s Privacy

Utopia is not intended for users under 18 years old. We do not knowingly collect personal information from children. If we learn that a child under 18 has provided personal information, we will delete it promptly.

Compliance with Laws

Utopia complies with applicable privacy laws, including the GDPR, CCPA, and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable. We do not collect or process sensitive personal data (e.g., Social Security numbers, biometric data) unless voluntarily provided, and we maintain safeguards to protect such data as required by law.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. We will notify users of material changes via the Platform or other communication channels. Continued use of Utopia after updates constitutes acceptance of the revised policy.
